*Since the original terms and conditions were published, we have added the current competition 'PlayStB World Cup 'Come-Down' which runs for two weeks up until 7.30pm January 1st, 2023. For each week of this competition, the three highest points scorers will receive a '66 football signed by Geoff Hurst. Each day, the three highest scoring players will each receive a PlayStB t-shirt. There is an additional prize - the Golden Boot. Players who score 5000+ points will automatically be entered in to a prize draw to win a Wayne Rooney signed England shirt. As per the T&Cs below, players can only win one of the signed footballs, and one t-shirt. These Terms and Conditions govern the Play StB World Cup Edition Tournament (the “Tournament”) and any player who registers to play in the Tournament (“you” or a “Player”).
The Promoter operates the website www.playStB.app (the “Website”) and also operates the Tournament and other games and competitions which are accessed through the Website.
Promoter may change these Terms and Conditions at any time; if the Terms and Conditions are changed, details of the changes made will be listed below this clause where the Terms and Conditions are printed on the website. Each Player should check the Website for any changes to these Terms and Conditions regularly.
The title of the Tournament is “Play StB World Cup Edition Tournament”.
The Tournament will run from [07.30am] on 17 November 2022 (the "Opening Date") to 7.30pm on 18 December 2022 (the "Closing Date") inclusive (the “Tournament Term”).
The Tournament will comprise two (2) successive rounds of spot-the-ball competitions (“Competition(s)”):
the World Cup Warm-Up 17-19 November 2022 inclusive
the Group Stage/Last 16 20 November – 6 December 2022 inclusive (Round 1); and
the Finals Stage 7 to 18 December 2022 inclusive (Round 2).
Registered Players will be able to play new competitions and games available every day during the Tournament Term including the “Daily Prize Play” Competitions and “Play For Fun” games, each as described in clause 5 below.
To enter the Tournament a Player must register on the Website to open an account (“StB Account”); as set out in clause 3 below.
There is no charge to open a StB Account nor to enter the Tournament.
All entries to the Tournament must be made online through the Website by no later than the closing time on the day of each Daily Prize Play game. The Website will not allow any entries to the Daily Prize Play games after the closing time on the day of that game and no entries will be allowed after the Closing Date.
1.1.1 The Tournament is open to all residents in the UK who are aged 18 years or over, and residents of any other jurisdiction where playing spot-the-ball is not prohibited by law and are aged 18 years or over.
1.2 All Players must satisfy themselves that registering for and playing a spot-the-ball game in their country of residence is not unlawful.
1.3 The following categories of people are excluded from eligibility:
1.3.1 employees of the Promoter or its holding or subsidiary companies;
1.3.2 employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with a Competition on the Website or its administration; or
1.3.3 members of the immediate families or households of 3.3.1 and 3.3.2 above.
1.4In entering a Competition in the Tournament, each Player must confirm that they are eligible to do so, that they have legal capacity to enter a competition, that they have read these Terms and Conditions and that they are eligible to claim any prize they may win. The Promoter may require any Player to provide proof that they are eligible to enter the Competition.
1.5When a Player enters a Competition in the Tournament, they confirm they are not breaching any laws in their country of residence regarding the legality of entering the Competitions. The Promoter will not be held responsible for any Player entering into a Competition unlawfully. If in any doubt, a Player should immediately leave the Website and check with the relevant authorities in their country.
4.To enter a Competition, each Player needs to create a StB Account on the Website and then follow the on-screen instructions to select the Competition they wish to enter.
To create a StB Account on the Website, Players will need to supply: an email address, a username (not their real name), date of birth, postcode and a unique passcode.
The email address used for a StB Account will be the username the Player uses to log into their StB Account and only one username can be used per StB Account.
All Players must check all details they input into their StB Account carefully as the Promoter will not be liable for any errors.
Every Player will be asked to confirm they have read and understood these Terms and Conditions.
Every Player will be asked to confirm they consent to the Privacy Policy and their name and points being on the leaderboard, by ticking a box.
Entering a Competition requires an internet connection. Players should check their internet connection before entering a Competition as am entry may be lost if the internet connection is lost or disrupted.Promoter reserves the right to refuse an incomplete entry for any reason or to disqualify an entry for any reason if they have reasonable grounds for suspicion that a Player is in breach of these Terms and Conditions.
The Promoter will not accept:
responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
proof of transmission as proof of receipt of Entry to a Competition;
entries that are automatically generated by computer;
entries that are completed by third parties or in bulk;
entries that are illegible, have been altered, reconstructed, forged or tampered with; or
entries that are incomplete.
There is a limit of one (1) entry to each Competition per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
The Promoter reserves all rights to disqualify a Player if their conduct is contrary to the spirit or intention of the Tournament.
By submitting an entry, a Player is agreeing to be bound by these Terms and Conditions and confirming that the Player agrees to their username and points tally being displayed on the public leaderboard on the Website throughout the Competition Term. Players who do not want to feature on the leaderboard should notify the Promoter of this and can play Fun Games only.
Players also agree to receive, via email, competition winning confirmations and notifications, updates to products, prizes and competitions. They will also need to conform to the promoter that they are happy to take part in social media requests.
5.Every day during the Tournament Term, there will be a “Daily Prize Play” which will be accessible to Players registered on the Website.
Access to play will go live from 07.30 and will close at 19.30; unless otherwise stated on the Website.
Once they commence playing a Competition, Players will be presented with a photographic image from a past football game with the ball removed from the image and must use their skill to mark where the removed ball was in the image within a limited time.
Each Player will have three (3) attempts to ‘spot’ the ball in the Daily Prize Play whilst the clock is ticking, a Player cannot lock or confirm their ‘spots’ until they have made all three (3) attempts to ‘spot’ the ball.
If a Player fails to confirm their marked ‘spots’ within the defined time, their marks will be null and void.
A Player can only enter a Competition once per day in the Tournament Term,
The winning ‘spot’ in a Competition will be revealed at 19.45 on the same day that Competition took place.
Promoter intends to allocate a token amount of points to all Players who position a ‘spot’ within the correct third of the image. Points are awarded based on a decreasing scale per ‘spot’ with the centre pixel of the original ball location holding the highest point score: the number of points a Player is awarded will depend on how close their marks are to the original location of the ball in the image.
The winner will be the Player who achieves the highest point score that day and will be awarded the winner’s prize for that day. The prize will be in the form of signed World Cup merchandise items as stated on the Website (value approx. £300).
There will be between 5 and 10 runners-up prizes for each Competition (announced on the day of the Daily Prize Draw) which will be in the form of World Cup merchandise (value approx. £10).
Players in the Daily Prize Plays during the warm-up round will accumulate points from each Daily Prize Play Competition played and those who accumulate the minimum individual points tally ( this is 20,000 points for Round 1, 10,000 points for Round 2 ) during the Round will achieve qualification to the Round 1 Prize Draw.
All qualifiers to the Round 1 Prize Draw will be displayed on a public leaderboard on the website where the points will accumulate for a Player in each Round of the Tournament.
The Player with the highest number of points on the leaderboard will receive a prize of merchandise (value approx. £300).
Players in the Daily Prize Plays during Round 1 will accumulate points from each Daily Prize Play played and those who accumulate the stated minimum individual points tally (for Round 2 this is 10,000 points) during the Round (potentially 17 games) will achieve qualification to the Round 2 Prize Draw.
All qualifiers to the Round 1 Prize Draw will be displayed on a public leaderboard on the Website where the points will accumulate for a Player in each Round of the Tournament.
Two prizes will be awarded in Round 2 which are:
(i) one (1) Prize Draw winner will be selected randomly from the qualifiers (through an automatic random electronic selector) and will receive the Round 2 Prize Draw prize of merchandise (value approx. £2500); and
(ii) the Player with the highest number of points on the leaderboard will receive a prize of merchandise (value approx. £300).
Players in the Daily Prize Plays during Round 2 will accumulate points from each Daily Prize Play competition played and those who accumulate the stated minimum individual points tally (for Round 2 this is 10,000 points) during the Round (potentially 14 games) will achieve qualification to the Round 2 Finals Stage.
All qualifiers to the Round 2 Prize Draw will be displayed on a public leaderboard on the Website where the points will accumulate for a Player in each Round of the Tournament.
Two prizes will be awarded in Round 2 which are:
(i) one (1) Prize Draw winner will be selected randomly from the qualifiers (through an automatic random electronic selector) and will receive the Round 2 Prize Draw prize of merchandise (value approx. £5000); and
(ii) the Player with the highest number of points on the leaderboard will receive a prize of merchandise (value approx. £300).
1.2.1 The Golden Boot award will be given to the Player who has accumulated the maximum amount of points on the leaderboard during the Tournament from playing Daily Prize Plays.
1.2.2 Should more than one (1) Player attain the maximum amount of points to tie for first place, all equal winners will be awarded an equivalent prize of merchandise (approx. value £2,000).
1.2.3 There will also be 5-10 runners-up for Golden Boot Award with the next highest individual scores on the leaderboard who will each receive a prize of merchandise (approx. £10 value).
1.3.1 Every day during the Tournament Term at least 30 free new spot-the-ball games will be released on the Website to enable registered Players to practice their skills for the Prize Play Games.
1.3.2 There are no prizes awarded for Play For Fun games, although if any registered Player should hit the bullseye (‘spot’ the ball in the centre pixel of the ball removed from the image), they will be rewarded with an immediate qualification and entry into the Prize Draw for the then current Round.
1.3.3 All scores from a Player’s Play For Fun games will be recorded in the “My Scores” section of that Player’s account on the Website and the Player can monitor and improve their average score per game. These scores are recorded for the Player’s interest only and will not count towards any leaderboard tallies.
1.3.4 Once a Play For Fun game has been played by a Player, it will not be available on the Website for that Player to play again.
The prizes for each Daily Prize Play Competition, each Round and the Golden Boot award will be announced on the Website.
The prizes are supplied by the Promoter who reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.
The prize is not negotiable or transferable.
Promoter shall use reasonable endeavours to award the prizes to the correct Players but if, due to reasons of hardware, software or other computer related failure, or due to human error, a prize is awarded incorrectly, Promoter reserves the right to reclaim any prize and award it to the correct Player. Promoter shall exercise this right in its sole discretion and without any admission of liability.
Following each Daily Prize Play, the Promoter will use their game management software with its digital database of coordinates to mathematically calculate how close the valid and eligible Players’ ‘spots’ are to the actual spot of the ball in the original image and a Player will score points for each ‘spot’ that is in the correct third of the original image. The closer a ‘spot’ is to the original location of the ball, the more points a Player will receive. The points for all three (3) ‘spots’ will be added together and the winning Player shall be the one whose ‘spots’ score the highest amount of points in that Daily Prize Play game.
In order to prevent use of bots, other automated software and gaming of our system, the Promoter will only allow any one registered player to win a MAXIMUM of ONE Daily Prize Play Prize (Signed ‘66 Retro Football) and ONE major Tournament Prize (Signed Pele & World Cup ‘66 Shirt, Signed Messi Boot).
This condition also applies to Runner-up prizes (T-shirts). If you are a Daily Winner or Runner-up, you will no longer qualify for another Daily Prize - but you can still play to qualify and participate in the Prize Draw (main Prizes) and the Golden Boot Prize.
In the advent a player fairly wins more than one competition, they will remain on top of the Leaderboard but the prize will be given to the next runner-up. Any evidence of cheating, player(s) will be disqualified from the competition and prizes will be awarded to the next runner-up.
The decision of the Promoter is final and no correspondence or discussion will be entered into.
The Promoter will contact each winner personally as soon as practicable after the related Competition, using the telephone number or email address provided with the Player’s StB Account. It is each Player’s responsibility to check they have the correct details on their StB Account and to update them when necessary. If for any reason they are incorrect, the Promoter will not be responsible for not being able to contact the winning Player and the prize may be forfeited to the next best Player in that Competition.
The Promoter will require each winner to verify their identity and age, and will arrange directly with the winner how to deliver the Prize to them. If a Player cannot verify their age or identity, then they may be disqualified from winning a prize and the prize will go to the next best Player in that Competition.
The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the username or surname of major prize winners and, if applicable, their winning entries on the Website. By entering a Competition, each Player has consented to Promoter featuring this information on the Website.
The Promoter will also ask the winning Player to submit a photographic image of their winning moment and for the Player’s permission to allow Promoter to use such image on the Website and on any of Promoter’s social media feeds.
If a Player objects to any or all of their surname, county and winning image being published or made available, they should contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
The Promoter will make all reasonable efforts to contact each winner. If a winner cannot be contacted or is not available, or has not claimed their prize within five (5) days of the announcement of their win, the Promoter reserves the right to offer the prize to the next eligible Player selected from the correct entries that were received before the Closing Date.
The Promoter may award the prize to the Player with the next closest ‘spot’ or where relevant, the next highest tally on the leaderboard, if the winner is disqualified as a result of contravening any of these Terms and Conditions.
The Promoter does not accept any responsibility if a Player is not able to take up the prize or the prize is forfeited under this clause.
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up a prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.
The Promoter excludes, to the maximum extent permissible by law, all representations, warranties and guarantees (whether express or implied) that may apply to the Website or its contents, including without limitation in relation to:
the correct and accurate performance of the software and the Website used to operate the Tournament; or
ensuring that the Website is free from viruses and other malware or other harmful material or event that may adversely affect a Player’s Competition entry, hardware, or software as a result of their use of the Website.
A Player’s statutory rights are not affected.
Access to the PlayStb.app Website is free of charge.
It is each Player’s responsibility to make any and all arrangements necessary in order to access the Website.
Access to the Website is provided “as is” and on an “as available” basis. Promoter may at any time alter, suspend or discontinue the Website and will not be liable to a Player in any way if the Website or any part of it is unavailable at any time during the Competition Term.
From time-to-time links to other websites may be included on the Website. Unless expressly stated, these websites are not under the control of Promoter and Promoter neither assumes nor accepts responsibility or liability for any content on third party sites.
Promoter exercises reasonable care and skill so far as is reasonably practicable to try to ensure that the Website is free from viruses and other malware, however Players are responsible at all times for protecting their own hardware, software, data and other materials from viruses, malware and other security risks.
A Player may not use the Website:
in any way that breaches any applicable local, national or international law or regulation;
in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
for the purpose of harming or attempting to harm minors in any way or to bully, insult, intimidate or humiliate any person;
to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;
to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;to upload terrorist content;
to access without authority, interfere with, damage or disrupt: any part of the Website, any equipment or network on which the Website is stored, any software used in the provision of the Website, or any equipment or network or software owned or used by any third party.
Failure to comply with clause 10.6 constitutes a material breach of these Terms and Conditions under which a Player is permitted to use the Website, and may result in Promoter removing a Player as a registered account holder, terminating a Player’s rights to access the Website and/or forfeiting any Competition prize, and/or may also result in legal proceedings against a Player for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
Promoter may also, following a breach of clause 10.6, disclose such information to law enforcement authorities as Promoter deems reasonably necessary or as required by law.
Promoter excludes any and all liability arising out of any actions (including but not limited to those set out in this clause 10) that Promoter takes in response to a Player’s breach of these Terms and Conditions.
Promoter either owns, or has a licence to use, any and all text, images, audio, video, scripts, code, software, databases and any other form of information capable of being stored on a computer that appears on, or forms part of, the Website (“Content”) and the copyright and other intellectual property rights subsisting in that Content, unless specifically labelled otherwise.
No Player may reproduce, copy, distribute, sell, rent, sub-licence, store or in any other manner re-use the Content without Promoter’s express written permission to do so.
All Competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
By submitting a Competition entry and any accompanying material, a Player agrees to:
assign to the Promoter all the relevant intellectual property rights with full title guarantee; and waive all moral rights,
in and to their Competition entry and otherwise arising in connection with the entry to which they may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
Player agrees that the Promoter may, but is not required to, make Player’s Competition entry available on its Website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. Player agrees to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Competition entry for such purposes.
Promoter grants Players the non-exclusive right to share the images (should they choose) from their own Daily Prize Play Competition entries showing (i) their locked ‘spots’ (pre-results) and (ii) their ‘spots’ against the winning reveal ball position (post-results) via social media / email channels.
All Players are automatically entered into Promoter’s database for the purpose of conveying information as to the status of their Competition entries, as well as any future competitions offered by Promoter.
The Promoter will only process a Player’s personal information as set out in the Privacy Policy. See also condition 4.8, 4.10 and 7.5, with regard to the publication of Competition results and announcement of winners.
If there is any reason to believe that there has been a breach of these Terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
These Terms and Conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
