Terms and Conditions of Entry and Website Use

1. About these Terms

1.1 These Terms and Conditions (the "Terms") govern the use of the website and application at www.playStB.app (the "Website") and entry into any game, competition or tournament made available through it. They apply to every person who registers an account or enters any Game (referred to as "you", "your" or a "Player").

1.2 By registering an account, and by entering any Game, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms you must not register an account or enter any Game.

1.3 These Terms should be read together with the Promoter's Privacy Policy, Cookie Policy and Responsible Play Policy, each of which is available on the Website and each of which forms part of your agreement with the Promoter.

1.4 Specific rules, entry requirements, opening and closing times, prize details and eligibility criteria for individual Games will be published on the Website alongside that Game (the "Game Rules"). The Game Rules form part of these Terms. Where there is any conflict between these Terms and the Game Rules for a particular Game, the Game Rules for that Game will take precedence in respect of that Game only.

1.5 Nothing in these Terms limits or excludes your statutory rights as a consumer.

1.6 Please note in particular that the winning position in every Game on the Website is decided by a panel of artificial intelligence judges, and not by human judges and not by reference to where the ball actually was in the original photograph. How this works, and how you can study the judges in order to play well, is explained in full at clause 6.

2. The Promoter

2.1 The promoter and operator of the Website and all Games is Green Fields Sporting Systems Ltd, a company incorporated in England and Wales with company number 12813603, whose registered office is at Rievaulx House, 1 St Mary's Court, York, YO24 1AH (the "Promoter", "we", "us" or "our").

2.2 You can contact us at any time using the contact details published on the Website, or by writing to us at the registered office address above.

3. Definitions

3.1 In these Terms, the following words have the following meanings:

"AI Judge" means an artificial intelligence system appointed by the Promoter under clause 6 to assess a Game image and determine where, in its assessment, the centre of the ball should be. Each AI Judge has its own judging style and its own way of weighing the features of an image.

"Daily Game" means a spot-the-ball competition of the type described in clause 8, offered on the Website and carrying a memorabilia or merchandise prize.

"Determination Record" means the record described in clause 6.11, containing the Winning Position for a Game and the details of how it was arrived at.

"Game" means any Daily Game, Weekly Tournament, Instant Win Game or Practice Game made available on the Website, and "Games" is construed accordingly.

"Head Judge" means the individual appointed by the Promoter under clause 6.10 to oversee, review and ratify the operation of the Judging Panel.

"Instant Win Game" means a spot-the-ball competition of the type described in clause 10, in which a Player who identifies the Winning Position exactly wins the stated prize immediately.

"Judge Profile" means the published description of an AI Judge referred to in clause 6.6.

"Judging Panel" means the AI Judges appointed by the Promoter under clause 6 to determine the Winning Position for a Game, together with the Head Judge.

"Practice Game" means a free spot-the-ball game offered for practice purposes only, as described in clause 11.

"Spot" means a single mark placed by a Player on the Game image to indicate where, in that Player's opinion, the centre of the ball should be.

"StB Account" means the registered account opened by a Player on the Website.

"Weekly Tournament" means a competition of the type described in clause 9, run over a defined period and determined by cumulative points scored across qualifying Games.

"Winning Position" means the position on a Game image determined by the Judging Panel in accordance with clause 6 as being where, in the Judging Panel's opinion, the centre of the ball should be.

4. Eligibility

4.1 To register an StB Account and enter any Game you must be aged 18 years or over.

4.2 Games are open to residents of the United Kingdom, and to residents of any other jurisdiction in which participation in a skill-based spot-the-ball competition of this kind is not prohibited or restricted by law.

4.3 It is your responsibility to satisfy yourself that registering for and entering the Games is lawful in your country of residence and in any country from which you access the Website. The Promoter does not accept responsibility for any Player who participates in breach of the laws applicable to them. If you are in any doubt, you should not register and should take independent advice.

4.4 The Promoter may restrict access to the Website, or to particular Games, from particular jurisdictions at any time and without notice.

4.5 The following people are not eligible to enter any Game carrying a prize:

(a) employees, officers and directors of the Promoter and of any holding company or subsidiary of the Promoter;

(b) the Head Judge, and any individual involved in the selection, configuration, training, tuning or oversight of any AI Judge;

(c) employees, officers and directors of any agent, supplier or contractor of the Promoter who is professionally connected with the Games or their administration; and

(d) members of the immediate family or household of any person falling within (a), (b) or (c).

4.6 By entering a Game you confirm that you are eligible to do so, that you have the legal capacity to enter into a binding agreement, and that you are eligible to claim any prize you may win. The Promoter may at any time require you to provide evidence of your identity, age and place of residence, and may withhold a prize until that evidence has been provided to its reasonable satisfaction.

5. Registering and managing an StB Account

5.1 To enter any Game you must first register an StB Account on the Website. There is no charge for opening or maintaining an StB Account.

5.2 To register you will be asked to provide an email address, a username (which must not be your real name), your date of birth, your postcode and a password. You must provide accurate and complete information and keep it up to date. The Promoter is not liable for any loss arising from inaccurate or out-of-date account information, including any failure to notify you that you have won a prize.

5.3 Only one StB Account may be held per person. The opening or operation of multiple accounts by the same person, or by persons acting together, is a breach of these Terms and will result in the closure of all associated accounts and the forfeiture of any prizes.

5.4 You are responsible for keeping your password confidential and for all activity that takes place through your StB Account. You must notify us immediately if you believe your account has been accessed without your authorisation.

5.5 You may close your StB Account at any time by contacting us using the details on the Website. Closure of your account will not affect any Game you have already validly entered before the closure takes effect.

5.6 Your username, and where relevant your score, may be displayed on public leaderboards on the Website. If you do not wish to appear on a leaderboard you may notify us and adjust your account settings, but you should be aware that you will not then be able to enter Weekly Tournaments, which are determined by reference to a published leaderboard.

5.7 Marketing communications are optional. You will only receive marketing emails from us if you have separately opted in to receive them, and you may withdraw that consent at any time by using the unsubscribe link in any marketing email or by changing your account settings. Service communications relating to Games you have entered, prizes you have won, and changes to these Terms will be sent to you regardless of your marketing preferences, as they are necessary to administer your participation.

6. How the Games work: skill and the Judging Panel

6.1 Every Game on the Website is a competition of skill and judgement.

6.2 In each Game you are presented with a photographic image taken from a sporting fixture, from which the ball has been digitally removed. You must use your skill and judgement to place a Spot at the position on the image where, in your opinion, the centre of the ball should be.

6.3 The Winning Position in each Game is not, and is not intended to be, the position at which the ball actually appeared in the original photograph. The Winning Position is the position at which, in the assessment of the Judging Panel, the centre of the ball should be.

6.4 The judges who make up the Judging Panel are artificial intelligence systems, not human beings. The Promoter states this openly and prominently on the Website. Each AI Judge is a distinct system with its own judging style, its own strengths, and its own way of weighing the features of an image, and different AI Judges will often reach different assessments of the same image.

6.5 In assessing an image, each AI Judge has regard to visible features of that image, including the posture, balance, eye-line and direction of movement of the players shown, the position and stance of the goalkeeper and defenders, the direction and phase of play, shadows and lighting, and the overall composition of the image. Every feature an AI Judge relies on is visible to you in the same image.

6.6 The Promoter publishes a Judge Profile for each AI Judge on the Website. Each Judge Profile sets out the AI Judge's name, a plain-English description of its judging style and the features it tends to weigh most heavily, and summary information about its past determinations. Judge Profiles are updated whenever an AI Judge changes, and archived Judge Profiles remain available.

6.7 Before each Game opens for entry, the Website will state which AI Judges make up the Judging Panel for that Game and the method by which their individual assessments are combined to produce the Winning Position. Neither the composition of the Judging Panel nor the combination method for a Game will be changed after that Game has opened for entry.

6.8 The AI Judges that make up the Judging Panel for a Game are not selected at random, and their individual assessments are not combined by any random or chance-based process. The combination method is fixed, published in advance, and applied identically to every Game to which it is stated to apply.

6.9 Each AI Judge is operated deterministically. For each Game, each AI Judge is run once against the Game image using a fixed model version and fixed configuration settings, which are recorded for that Game. Configured in this way, an AI Judge presented with the same image will reach the same assessment. The Winning Position for a Game is therefore fixed, and is not the product of a randomised or variable process.

6.10 The Promoter appoints a named individual as Head Judge. The Head Judge is independent of the day-to-day operation of the Games and is responsible for overseeing the Judging Panel, reviewing and ratifying the determination for each Game before it is sealed under clause 6.11, and directing that a Game be withdrawn and not offered for entry where a determination is obviously unsound. The name of the Head Judge is published on the Website.

6.11 Before a Game opens for entry, the Promoter records the Winning Position for that Game, the individual assessment of each AI Judge on the panel, the model version and configuration settings used by each AI Judge, the combination method applied, the time of determination, and the Head Judge's ratification. Together these form the Determination Record for that Game.

6.12 The Promoter will publish a cryptographic hash of the Determination Record on the Website before the Game opens for entry, and will publish the full Determination Record after the Game has closed. This allows any Player to verify for themselves that the Winning Position was fixed before entries opened and was not altered afterwards.

6.13 No Player, and no employee or contractor of the Promoter involved in the day-to-day operation of a Game, has access to the Winning Position for that Game before its closing time.

6.14 Success in a Game therefore depends on your skill and judgement in reading the image and in anticipating how the particular AI Judges named for that Game will assess it. Because each AI Judge's style is published, because past Determination Records are available, and because you know in advance which judges will decide each Game, you are able to study the judges, learn how each of them weighs the features of an image, and improve your performance through practice and experience. Practice Games are made available free of charge on the Website for this purpose.

6.15 If the Promoter changes the model version or configuration used by an AI Judge, or introduces or retires an AI Judge, it will publish notice of the change on the Website at least seven (7) days before that change takes effect in any Game carrying a prize, and will update the relevant Judge Profile at the same time.

6.16 The AI Judges make no decision about any Player. They assess an image and determine the Winning Position for a Game before any entry to that Game has been submitted, and they do not see, and are not provided with, any Player's entry.

6.17 The determination of the Judging Panel as to the Winning Position for any Game is final. This does not affect your right to complain about the operation of a Game under clause 18, or your statutory rights.

7. Entry, entry fees and the free entry route

7.1 To enter a Game, log in to your StB Account, select the Game you wish to enter and follow the on-screen instructions. Entries must be submitted through the Website before the closing time published for that Game. The Website will not accept entries after the closing time.

7.2 Entry to a Game requires a working internet connection. You should check your connection before entering, as an entry may be lost if your connection is interrupted before the entry is confirmed. An entry is only valid once it has been confirmed by the Website and appears in the "My Entries" section of your StB Account. Proof of sending is not proof of receipt.

7.3 The entry fee for each prize Game, if any, will be clearly displayed on the Website before you commit to entry. The total price payable, inclusive of all charges, will be shown to you before you confirm your entry. There are no compulsory additional charges.

7.4 A free entry route is available for every Game that carries an entry fee. A free entry submitted in accordance with this clause 7 is treated in exactly the same way as a paid entry, is judged on exactly the same basis, and has exactly the same opportunity to win.

7.5 To enter a Game free of charge, send your entry by first class post to: PlayStB Free Entry, Green Fields Sporting Systems Ltd, Rievaulx House, 1 St Mary's Court, York, YO24 1AH. Your entry must be on a single unenclosed postcard and must state: your full name; your date of birth; your postal address; your email address; your StB Account username; the name and date of the Game you wish to enter; and the coordinates of your chosen Spot or Spots, expressed as instructed on the Website for that Game.

7.6 Free postal entries must be received by the Promoter before the closing time for the relevant Game. The Promoter does not accept responsibility for postal entries that are lost, delayed or damaged in the post. You are advised to allow at least three working days for delivery.

7.7 Only one free postal entry may be submitted per person per Game. Bulk entries, entries submitted by third parties on behalf of a Player, entries submitted in envelopes, and photocopied, mechanically reproduced or computer-generated entries will not be accepted.

7.8 Where you pay an entry fee, you are entering into a distance contract with the Promoter for the provision of a service. By confirming your entry you request that the Promoter begins to provide that service immediately, and you acknowledge that once your entry has been submitted and the relevant Game has closed, you will lose your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you wish to cancel a paid entry before the relevant Game has closed, contact us and we will cancel the entry and refund the entry fee in full.

7.9 The Promoter operates a Responsible Play Policy, available on the Website. You may at any time set a limit on the amount you spend on entry fees over a given period, or ask us to suspend or close your account. We will act on any such request within one working day and will not send you marketing communications once a request has been made.

7.10 The Promoter may refuse or disqualify any entry which:

(a) is incomplete, illegible, altered, reconstructed, forged or otherwise tampered with;

(b) is generated automatically, in whole or in part, by any bot, script, macro, automated system or other software;

(c) is submitted by or on behalf of a third party, or submitted in bulk;

(d) is submitted from a duplicate, shared or fraudulently opened account; or

(e) the Promoter has reasonable grounds to believe has been submitted in breach of these Terms or otherwise contrary to the spirit of fair play.

7.11 The Promoter does not accept responsibility for entries that are lost, mislaid, damaged or delayed for any reason, including as a result of any equipment failure, technical malfunction, network, server, hardware or software failure of any kind.

8. Daily Games

8.1 A new Daily Game will be released on the Website each day, unless otherwise stated on the Website. The opening and closing times for each Daily Game will be published on the Website alongside that Game.

8.2 You may enter each Daily Game once only.

8.3 In each Daily Game you will be given a defined period in which to place three Spots on the image. You may adjust your Spots at any time before you confirm them, but you may not confirm them until all three have been placed. If you do not confirm your Spots before the timer expires, your entry will be void and you will not be entered into that Daily Game.

8.4 After the Daily Game closes, the Winning Position determined by the Judging Panel will be revealed on the Website at the time published for that Game.

8.5 Points are awarded on a decreasing scale according to how close each of your Spots is to the Winning Position, with the greatest number of points awarded for a Spot placed on the exact pixel of the Winning Position. No points are awarded for a Spot placed outside the scoring zone published for that Game. The points scored by your three Spots are added together to produce your score for that Daily Game.

8.6 The winner of each Daily Game is the Player with the highest score for that Game. Runner-up prizes may be awarded to the Players with the next highest scores, as published in the Game Rules for that Game.

8.7 Prizes for Daily Games consist of sporting memorabilia and merchandise. The prize for each Daily Game, and its approximate value, will be published on the Website before that Game opens.

8.8 If two or more Players achieve the same highest score in a Daily Game, the prize will be awarded to the Player whose entry was confirmed first, as recorded by the Promoter's systems. Where the Game Rules for a particular Game provide for a different tie-break, those Game Rules will apply.

8.9 In order to spread prizes fairly across the Player base and to reduce the incentive for automated or coordinated play, a Player may win no more than one Daily Game prize in any period of [seven (7)] days. A Player who has already won a Daily Game prize within that period will remain on the leaderboard and will continue to accumulate points towards any Weekly Tournament, but the Daily Game prize will be awarded to the Player with the next highest score. This restriction will be stated in the Game Rules for each Daily Game.

9. Weekly Tournaments

9.1 The Promoter will run a Weekly Tournament over a defined period, the opening and closing dates and times of which will be published on the Website (the "Tournament Period").

9.2 Points scored by a Player in each qualifying Daily Game played during the Tournament Period accumulate towards that Player's tournament total. The Game Rules will identify which Games qualify.

9.3 Tournament totals are displayed on a public leaderboard on the Website. Players who have opted out of leaderboard display under clause 5.6 cannot take part in Weekly Tournaments.

9.4 The Weekly Tournament prize or prizes, their approximate value, the number of prizes available and any minimum points threshold for qualification will be published on the Website before the Tournament Period opens.

9.5 The winner of a Weekly Tournament is the Player with the highest tournament total at the close of the Tournament Period. Where more than one prize is offered, prizes will be awarded in descending order of tournament total.

9.6 If two or more Players finish the Tournament Period with the same total, and that total qualifies for a prize, each tying Player will receive a prize of equal value, unless the Game Rules for that Tournament provide otherwise.

9.7 Where the Game Rules provide for a prize to be allocated among qualifying Players other than by ranked score, that allocation will be made by reference to the Players' scores achieved in a designated tie-break Game determined by the Judging Panel in accordance with clause 6, and not by any random or chance-based process.

9.8 A Player may win no more than one Weekly Tournament prize in any Tournament Period. Winning a Daily Game prize does not disqualify a Player from winning a Weekly Tournament prize.

10. Instant Win Games

10.1 Instant Win Games operate on the same basis as all other Games on the Website. The Winning Position for each Instant Win Game is determined in advance by the Judging Panel in accordance with clause 6, is recorded and time-stamped, and is held securely and inaccessibly until the Game closes.

10.2 In an Instant Win Game you place [one (1)] Spot on the image within the time allowed. If your Spot is placed on the exact pixel of the Winning Position, you win the stated prize immediately, and this will be confirmed to you on screen and by email.

10.3 If your Spot is not placed on the exact pixel of the Winning Position, you do not win an instant prize. Your score for the Instant Win Game may nevertheless count towards any Weekly Tournament, where the Game Rules so provide.

10.4 The prize available in each Instant Win Game, and its approximate value, will be published on the Website before that Game opens. Where a prize is not won, the Game Rules will state whether the prize is withdrawn, carried forward to a subsequent Instant Win Game, or otherwise dealt with.

10.5 An on-screen message indicating a win is confirmation of a valid entry having matched the Winning Position, and is subject to verification by the Promoter under clause 13. Where a technical fault, software error or system malfunction causes an incorrect win notification to be displayed, no prize is won and the Promoter will notify the affected Player as soon as reasonably practicable. The Promoter will not unreasonably rely on this clause and will bear the cost of any error that is its own fault where a Player has acted in good faith and to their detriment in reliance on the notification.

10.6 The number of Instant Win Games a Player may enter in any period, and the maximum number of Instant Win prizes a Player may win in any period, will be stated in the Game Rules.

11. Practice Games

11.1 The Promoter will make free Practice Games available on the Website so that Players can develop and test their skill and judgement. Practice Games carry no prize.

11.2 Scores from Practice Games are recorded in the "My Scores" area of your StB Account for your own information. They do not count towards any leaderboard, Weekly Tournament or prize.

11.3 Once you have played a particular Practice Game it will not be available to you again.

12. Prizes

12.1 The prize for each Game, together with its approximate value, will be published on the Website before that Game opens. Prizes are supplied by the Promoter.

12.2 Prizes are not transferable and there is no cash alternative. A prize may not be sold, exchanged or assigned before it has been delivered to the winner.

12.3 The Promoter reserves the right to substitute a prize with an alternative prize of equal or greater value where circumstances beyond its reasonable control make it necessary to do so.

12.4 Where a prize consists of signed or authenticated memorabilia, the Promoter will supply such certificate or evidence of authenticity as it has received from its supplier. The Promoter gives no further warranty as to authenticity beyond that certificate, save that the Promoter warrants that it has taken reasonable steps to source memorabilia from reputable suppliers.

12.5 The Promoter will use reasonable endeavours to award prizes correctly. If, because of a hardware, software or other technical failure, or because of human error, a prize is awarded to the wrong Player, the Promoter may reclaim that prize and award it to the correct Player. The Promoter will exercise this right reasonably and will not seek to reclaim a prize from a Player who has acted in good faith where it would be unreasonable in all the circumstances to do so.

12.6 You are responsible for any tax liability arising from receipt of a prize, and for making any necessary declaration to HM Revenue & Customs or the equivalent authority in your country of residence.

13. Notifying and verifying winners

13.1 The Promoter will contact each winner as soon as reasonably practicable after the relevant Game closes, using the email address or telephone number held on that Player's StB Account. It is your responsibility to ensure your contact details are correct and current.

13.2 Before a prize is awarded, the Promoter will require the winner to verify their identity, age and address. If a Player is unable or unwilling to provide satisfactory verification, the Promoter may disqualify that Player and award the prize to the Player with the next highest score.

13.3 If a winner cannot be contacted, or has not claimed their prize, within fourteen (14) days of the Promoter first attempting to notify them, the Promoter may award the prize to the Player with the next highest qualifying score. The Promoter will make at least two attempts to contact a winner before treating a prize as unclaimed.

13.4 Where a winner is disqualified for breach of these Terms, the prize may be awarded to the Player with the next highest qualifying score.

13.5 The Promoter does not accept responsibility if a Player is unable to take up a prize, or if a prize is forfeited under this clause.

14. Publication of results

14.1 The Promoter is required to publish, or make available, information showing that a valid award of each prize took place. To comply with this, the Promoter will publish on the Website the username and county of the winner of each prize Game, together with the winning entry where applicable.

14.2 If you object to your username or county being published, you may notify the Promoter before the relevant Game closes and the Promoter will not publish that information. In those circumstances the Promoter must still provide your name, county and winning entry to the Advertising Standards Authority on request.

14.3 The Promoter may invite a winner to provide a photograph, video or written comment about their win, and to take part in reasonable publicity. Participation in publicity is entirely voluntary, is not a condition of receiving a prize, and any material you provide will only be used with your specific consent, which you may withdraw at any time.

15. Fair play

15.1 You must not use, and must not attempt to use, any bot, script, macro, automated entry system, image-analysis software, artificial intelligence tool, emulator or other technical means to place, calculate or optimise a Spot, or to enter any Game other than by your own personal skill and judgement.

15.2 You must not collude with any other Player, operate or benefit from multiple accounts, share account credentials, or otherwise act with any other person in a coordinated manner to increase the prospect of winning a prize.

15.3 You must not attempt to access, obtain, reverse-engineer or infer the Winning Position for any Game before it is published, nor interfere with the Website, the Judging Panel or the operation of any Game.

15.4 The Promoter monitors entry patterns for evidence of automated or coordinated play. Where the Promoter has reasonable grounds to believe that a Player has acted in breach of this clause 15, it may void that Player's entries, withhold or reclaim any prize, suspend or close the Player's StB Account, and refuse to accept further entries from that Player.

15.5 Monitoring under clause 15.4 is carried out partly by automated means. No entry will be voided, prize withheld or account closed on the basis of automated monitoring alone: any such decision will be reviewed by a member of the Promoter's staff before it takes effect.

15.6 Before taking action under clause 15.4, the Promoter will, wherever reasonably practicable, notify the Player of the concern and give them a reasonable opportunity to respond. The Promoter will act proportionately and will explain the reason for any decision, unless doing so would prejudice the detection or prevention of fraud. You may ask for any such decision to be reconsidered by a person, put your point of view, and contest the decision, by contacting us under clause 18.

16. Suspension and closure of accounts

16.1 The Promoter may suspend or close your StB Account, and cancel any pending entries, if:

(a) you are or become ineligible under clause 4;

(b) you materially breach these Terms, including clause 15 or clause 19;

(c) the Promoter has reasonable grounds to suspect fraudulent, unlawful or abusive activity in connection with your account; or

(d) the Promoter is required to do so by law or by any regulator or court.

16.2 Where the Promoter suspends or closes your account it will notify you and, unless prevented from doing so by law or by the need to prevent or detect fraud, will give its reasons. Where an account is closed and you have paid entry fees for Games that have not yet closed, those fees will be refunded unless the closure arises from your fraud or material breach of clause 15.

16.3 You may close your account at any time under clause 5.5.

17. Cancellation, suspension and amendment of Games

17.1 The Promoter may void, suspend, cancel or amend any Game where it becomes necessary to do so for reasons outside its reasonable control, including technical failure, unavailability of a prize, suspected fraud, or a requirement of law or regulation.

17.2 Where a Game carrying an entry fee is cancelled or voided before its result is determined, the Promoter will refund all entry fees paid for that Game.

17.3 The Promoter will not exercise its rights under this clause 17 to avoid awarding a prize that has been validly won.

18. Complaints and disputes

18.1 If you are unhappy with any aspect of a Game or your dealings with the Promoter, please contact us using the details on the Website. We will acknowledge your complaint within three working days and aim to provide a substantive response within fourteen days.

18.2 If you are not satisfied with our response, you may refer the matter to [name of alternative dispute resolution provider], details of which are available on the Website.

18.3 The determination of the Judging Panel as to the Winning Position for any Game is final and is not open to challenge. This does not prevent you from complaining about the fairness or operation of a Game, or from exercising any right you have at law.

18.4 Nothing in these Terms prevents you from bringing legal proceedings, or affects your statutory rights.

19. Use of the Website

19.1 Access to the Website is provided free of charge. It is your responsibility to make any arrangements necessary to access the Website, including obtaining a suitable device and internet connection.

19.2 The Website is provided on an "as is" and "as available" basis. The Promoter may alter, suspend or discontinue the Website or any part of it at any time.

19.3 You may not use the Website:

(a) in any way that breaches any applicable local, national or international law or regulation;

(b) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

(c) to harm or attempt to harm any person, or to bully, insult, intimidate or humiliate any person;

(d) to send, receive, upload, download or re-use any material that does not comply with the Promoter's content standards;

(e) to transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material;

(f) to transmit or upload any viruses, trojans, worms, time-bombs, keystroke loggers, spyware, adware or other harmful code;

(g) to upload terrorist content or any content that is illegal or harmful to children; or

(h) to access without authority, interfere with, damage or disrupt any part of the Website, any equipment or network on which it is stored, or any software used in its provision.

19.4 A breach of clause 19.3 is a material breach of these Terms and may result in the Promoter closing your account, terminating your access to the Website, forfeiting any prize, and reporting the matter to law enforcement authorities. The Promoter may also bring proceedings to recover its reasonable costs arising from the breach.

19.5 The Promoter exercises reasonable care and skill to keep the Website free from viruses and other malware, but you remain responsible for protecting your own device, software and data.

19.6 The Website may contain links to third party websites. Those websites are not under the Promoter's control and the Promoter accepts no responsibility for their content.

20. Intellectual property

20.1 The Promoter owns, or is licensed to use, all text, images, audio, video, code, software, databases and other material that appears on or forms part of the Website (the "Content"), together with all intellectual property rights in that Content.

20.2 You may not reproduce, copy, distribute, sell, rent, sub-licence, store or otherwise re-use the Content without the Promoter's express written permission.

20.3 You grant the Promoter a non-exclusive, worldwide, royalty-free licence to use, store, reproduce and display the coordinates of the Spots you submit and your score, for the purposes of operating and administering the Games, publishing results and leaderboards, preventing fraud, and analysing and improving the Games.

20.4 Where you separately submit photographs, video or written material to the Promoter, including in connection with publicity under clause 14.3, you retain ownership of that material and grant the Promoter a non-exclusive licence to use it for the purposes and for the period you agree at the time you submit it.

20.5 The Promoter grants you a non-exclusive right to share images generated by the Website from your own entries, showing your confirmed Spots before the result and your Spots against the revealed Winning Position after the result, via social media and email.

21. Data protection

21.1 The Promoter processes personal data in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018. Full details of what data is collected, the lawful bases relied on, how long data is kept and your rights are set out in the Privacy Policy on the Website.

21.2 In summary, the Promoter processes your personal data in order to operate your account and administer your entries and any prizes (necessary for the performance of its contract with you), to verify identity and age and to prevent fraud (necessary for its legitimate interests and to comply with legal obligations), to publish results in accordance with clause 14 (necessary for its legitimate interests in demonstrating that prizes were validly awarded), and to send marketing communications where you have opted in (consent).

21.3 You have the right to access your personal data, to have it corrected or erased, to restrict or object to its processing, and to data portability. You may exercise these rights by contacting us. You also have the right to complain to the Information Commissioner's Office.

21.4 The AI Judges do not process your personal data and make no decision about you. As set out in clause 6.16, they assess a Game image and determine the Winning Position before any entry to that Game is submitted, and they are not provided with any Player's entry or account information.

21.5 The Promoter does use automated processing to monitor entry patterns for evidence of automated or coordinated play. Where such processing could lead to a decision that significantly affects you, including voiding entries, withholding a prize or closing your account, that decision will not be taken by automated means alone. A member of the Promoter's staff will review it before it takes effect, and you have the right to obtain human intervention, to express your point of view and to contest the decision.

22. Liability

22.1 Nothing in these Terms excludes or limits the Promoter's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

22.2 Subject to clause 22.1, the Promoter is not liable for any loss, damage, personal injury or death arising from the taking up or use of a prize, except to the extent caused by the negligence of the Promoter, its agents, distributors or their employees.

22.3 Subject to clause 22.1, the Promoter is not liable for any loss or damage that was not reasonably foreseeable at the time you entered a Game, or for any loss of profit, loss of business, business interruption or loss of business opportunity.

22.4 Subject to clause 22.1, the Promoter's total liability to you in respect of any Game is limited to the greater of the entry fee you paid for that Game and the published value of the prize for that Game.

22.5 The Promoter excludes, to the maximum extent permitted by law, all representations, warranties and guarantees (express or implied) relating to the Website and its Content, including as to the uninterrupted or error-free performance of the Website and the software used to operate the Games.

22.6 Your statutory rights as a consumer are not affected.

23. Changes to these Terms

23.1 The Promoter may amend these Terms from time to time, for example to reflect changes in the law, in regulatory guidance, in the Games offered, or in the way the Website operates.

23.2 The Promoter will give you at least fourteen (14) days' notice of any material change, by email to the address held on your StB Account and by notice on the Website, before that change takes effect. A summary of changes and the date they took effect will be maintained beneath these Terms on the Website.

23.3 If you do not accept a change, you may close your StB Account under clause 5.5 before the change takes effect, and the Promoter will refund any entry fees you have paid for Games that have not yet closed.

23.4 Changes required by law or regulation may take effect immediately, in which case the Promoter will notify you as soon as reasonably practicable.

23.5 The version of these Terms in force at the time you enter a Game applies to that entry.

24. General

24.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

24.2 A failure or delay by the Promoter in exercising any right under these Terms does not amount to a waiver of that right.

24.3 These Terms are between you and the Promoter. No other person has any right to enforce any of these Terms.

24.4 You may not transfer your rights or obligations under these Terms to any other person. The Promoter may transfer its rights and obligations to another entity, and will notify you if it does so, provided this does not affect your rights under these Terms.

24.5 These Terms, and any dispute arising out of or in connection with them or their subject matter, are governed by the law of England and Wales.

24.6 You and the Promoter both submit to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you live.
